Artificial Intelligence and Copyright Law: Balancing the competing interests of rights-holders, AI developers and users in the UK and Germany

This event will explore the comparative challenges in the UK and German jurisdictions regarding Copyright Law issues related to the training of generative models such as ChatGPT and Stable Diffusion. It will examine questions of whether such activity constitutes copyright infringement, the rights of authors and the rights of users, and whether regional or global IP licensing solutions are feasible.
Chair
Prof Martin Kretschmer (University of Glasgow/Visiting Fellow, LSE) – Prof Kretschmer is the Director of the University of Glasgow AHRC Centre for the Regulation of the Creative Economy (CREATe) which is developing new methodologies to study regulation of IP-driven industries such as Film, Music and Video Games. He is an expert in Intellectual Property Law and Cultural Economics. He has led many independent reports, including for the UK Cabinet Office, the UK Intellectual Property Office, and the European Parliament.

Dr Anna Bernzen (University of Regensburg) – Dr Bernzen is an Assistant Professor at the University of Regensburg and a Visiting Fellow at LSE during 2024-25. She has published widely on matters of intellectual property law. She is currently working on a project investigating generative artificial intelligence in the UK and Germany.
Discussants
Dr Luke McDonagh (LSE) – Dr McDonagh is an Associate Professor at LSE Law School and a Visiting Fellow at the University of Geneva. His publications include articles analysing the consequences of Artificial Intelligence technologies for copyright law and patent law.
Dr Alina Trapova (UCL) – Dr Trapova is an Assistant Professor at UCL and is an internationally recognised expert on intellectual property law and Artificial Intelligence.
Mr Garret Edwards (Scuola Superiore Sant`Anna, Pisa) – Mr Edwards is an LSE LLM alumnus and is currently completing a PhD at Scuola Superiore Sant`Anna in Pisa. His project concerns authors` rights, Artificial Intelligence, and intellectual property law.
Dr Enrico Bonadio (City Law School) – Dr Bonadio is a Reader at City Law School. He has written several publications on the topic of AI and law. He has contributed expert opinions to the EU Parliament on issues relevant to technological standards and intellectual property.
