SUMMARY:Live Broadcast of the ICJ’s Advisory Proceedings on Climate Change
DESCRIPTION:Come along to watch the live broadcast of the opening of the advisory proceedings of the International Court of Justice (ICJ) on climate change\, focused on the arguments of Vanuatu and Melanesian Spearhead Group. \nThe advisory opinion given by the Court after its two-week hearing is expected to set the agenda for general international law on climate change and energy transition\, above and beyond the diplomatic agenda of the climate COPs. \nStudents with an interest in international law\, oral advocacy\, and/or environmental issues are particularly encouraged to drop in at any time. \nBy way of background\, on 29 March 2023\, the UN General Assembly (UNGA) adopted a resolution by consensus (A/RES/77/276)\, led by Vanuatu and over 100 co-sponsors on the original initiative of Pacific Island Students Fighting Climate Change. The UNGA thereby requested the ICJ to give an advisory opinion on the following questions: \n\nWhat are the obligations of States under international law to ensure the protection of the climate system and other parts of the environment from anthropogenic greenhouse gas (GHG) emissions for States and for present and future generations?\nWhat are the legal consequences under these obligations for States where they\, by their acts and omissions\, have caused significant harm to the climate system and other parts of the environment\, with respect to:\n\n(a) States\, including small island developing States (SIDS)\, which\, due to their geographical circumstances and level of development\, are injured or specially affected by\, or are particularly vulnerable to\, the adverse effects of climate change? \n(b) Peoples and individuals of the present and future generations affected by the adverse effects of climate change?

SUMMARY:Nafay Choudhury: ‘Bazaar Governance: Legal Pluralism and Economic Order in an Afghan Marketplace’
DESCRIPTION:We are delighted to present the first event in the new LSE Law and Anthropology Seminar Series\, supported jointly by the Law School and the Anthropology Department. \nOur inaugural speaker will be Dr. Nafay Choudhury\, Assistant Professor of Law at the LSE\, on the topic of ‘Bazaar Governance: Legal Pluralism and Economic Order in an Afghan Marketplace’. All interested LSE staff and students are very welcome to attend. Capacity is limited\, and the event operates on a first come basis. \nAlternatively\, to join hybrid please register here \nTopic: \nBased on 16 months of ethnographic fieldwork in Afghanistan\, this presentation explores the maintenance of order within Afghanistan’s central money exchanger bazaar\, Sarai Shahzada. The bazaar plays a central role in the running of the country’s entire economy despite operating with a high degree of autonomy from the state. The presentation explores the various governance practices within the bazaar\, which bring together overlapping and interpenetrating elements of state law\, non-state law and extra-legal arrangements based on based on trust. I employ the term entangled governance to capture the convergence of these different forms of ordering. Entangled governance turns attention to the hybrid assemblage of diverse logics and rationalities employed by individuals that contributes to the overall maintenance of order. It highlights the messy\, inconsistent and contingent nature of order within a social setting. Ethnographic insights help to provide a granular account of the “organized chaos” or “patterned contingency” that characterizes the continued success of the bazaar. \nSpeaker: \nDr. Nafay Choudhury joined the LSE in 2023 and is Assistant Professor of Law (Socio-Legal Studies). His work sits at the intersection of socio-legal studies\, legal pluralism\, economic development\, private law\, and the rule of law. He studies the fragmented and plural forms of order that exist within the state\, alongside the state\, and beyond the state. His current research looks at the role of market associations in providing normative order in fragile settings. His book manuscript (under contract with Cambridge University Press) examines non-state legal ordering through an ethnographic study of Afghanistan’s money exchangers. \nThis seminar will operate on a first-come\, first-served basis.

James co-leads the Firm’s global credit funds and sovereign wealth funds initiatives. \nJames advises a broad range of sponsors and investors\, covering the establishment of all types of private funds\, and advice to sovereign wealth funds\, seed investors\, pension funds\, family offices\, and financial institutions\, across a range of private and public market strategies. James’s sponsor practice is particularly strong in credit-related strategies of all types across the liquidity spectrum\, including credit opportunities\, corporate funding solutions\, litigation funding\, special opportunities\, and special situations/distressed. Failure to do so will regrettably result in denial of entry. \nThis certificate Master Class Series at LSE Law School is designed to provide students with a comprehensive introduction to regulatory issues arising in the sphere of ‘FinTech’ and ‘Digital Finance’. Both terms are used interchangeably and refer to technology-enabled financial services and products that are either novel\, or traditional and provided in structurally novel ways. FinTech and Digital Finance do not have an existence apart\, rather\, they are part of the continuously evolving financial market as it keeps developing. \nDiscussion on FinTech typically focusses on terms such as blockchain\, stablecoin\, CBDC\, robo-advice\, and mobile payment. However\, to really understand these developments and identify key structural trends they are best discussed by reference to a number of – wider – central themes\, notably regulatory arbitrage\, the increasing use of technology\, datafication\, and the convergence of financial services with other markets\, such as social media and e-commerce. \nOur Convene Master Class Series will break down these developments and set them into their regulatory and legal context. It cuts across matters addressed in the curriculum at LSE Law School\, such as financial regulation and financial law\, commercial and corporate law\, data regulation and competition law. \nThis course is open exclusively to LLM and LLB students at LSE Law School. Cumberland Lodge is a Royal House set in the picturesque surroundings of the Great Park\, Windsor. Every year\, the Law School arranges a weekend away for staff and students\, the purpose of which is to create an informal and friendly environment where issues related to the law can be discussed. \nThe trip is subsidised by the Law School\, but each student who attends will be required to contribute a sum of £105.00. This price includes accommodation\, food and transportation to and from Cumberland Lodge. \nThe discussions centre around a series of lectures given by a number of speakers\, from the legal profession and academia. The lectures usually cover a diverse range of topics and disciplines\, ranging from such things as international human rights and environmental protection to contemporary problems in company law and criminal justice reform. SUMMARY:Socio-Legal Hub Seminar Series: Law\, Registration\, and the State: Making Identities through Space\, Place\, and Movement
DESCRIPTION:The Socio-Legal Hub Seminar Series is a forum for substantive\, methodological and conceptual discussions within the field of socio-legal studies. \n \nIn this talk\, I will present findings from my book Law\, Registration\, and the State: Making Identities through Space\, Place\, and Movement (Routledge\, 2023). Critical legal and socio-legal scholarship tends to assume that registration is a textually mediated act of statecraft which governs through the technology of writing. Taking a different approach\, the book develops movement as socio-legal method to illustrate the legal\, social\, and bureaucratic layers of movement which unfold in everyday engagements with the law. The book presents empirical and theoretical analysis of historical\, contemporary\, and future-oriented places of registration: a community hub\, a city of pilgrimage\, and the General Register Office. Drawing from diverse perspectives across anthropology\, geography\, sociology\, architecture\, and mobility studies\, the book argues for an understanding of registration as evolving\, socially constructed\, and shaped by spatial imaginaries which are materialised in its architecture. This mobile understanding of registration expands conceptual discussions of legal materiality whilst opening up possibilities for legal identities unconstrained by the assumed desirability of stability or endurance. \nSpeaker: Dr Jess Connolly-Smith \nDr Jess Connolly-Smith is a Senior Lecturer at the University of Lincoln and Visiting Fellow at LHub\, Institute of Advanced Legal Studies. Jess is an interdisciplinary socio-legal scholar with research interests in the areas of legal geography\, law and identity\, and socio-legal theory. Jess’s research explores how law engages in abstract and material practices of meaning-making to produce identities which construct\, shape\, and permeate our experience of everyday life. To date\, Jess has explored concepts essential to the construction of identity including registration\, movement\, place\, and the sacred/secular. Jess is particularly interested in how identities are built through the interaction between human (individual\, citizen\, gender\, person) and non-human (buildings\, places\, communities\, publics). She is currently working on a research project which looks to develop a socio-legal approach to quiet and its intersections with everyday life. Dr Connolly-Smith is the author of Law\, Registration\, and the State: Making Identities through Space\, Place\, and Movement (Routledge\, 2023) – awarded the Hart-SLSA Prize for Early Career Academics 2024. SUMMARY:Book Launch - Mitigation in the Law of Damages
DESCRIPTION:The law of mitigation determines how a claimant’s own response to a breach affects the damages they can recover. It responds to the basic accusation: ‘although I did wrong\, you made things worse’. Mitigation applies to all claims for compensation\, regardless of the claimant’s cause of action and irrespective of the defendant’s level of fault. It is amongst the most litigated doctrines in private law and has significant implications for general theories of damages\, and yet has received relatively little scholarly attention to date. \nMitigation in the Law of Damages provides the first comprehensive theoretical and doctrinal treatment of this important area of the law in any common law jurisdiction. It argues that contrary to the leading texts on damages\, judges have been right all along to explain mitigation as an aspect of causation. But to see why\, we must look beyond the ‘but-for’ concept of causation and understand the ‘common-sense’ causal principles used to attribute responsibility outside the law. This approach reveals a new understanding of the rules of mitigation and their relation to other doctrines. \nThe implications are wide-ranging. First\, mitigation applies symmetrically to benefits as well as harms\, and encompasses a variety of damages doctrines that have previously been regarded as distinct. Second\, the new account of mitigation advances our understanding of the legal concepts of causation\, choice\, and loss\, and calls for a re-evaluation of existing theories of damages.
